What Is Considered a DWI in Missouri?

In Missouri, you can be charged with a DWI for driving a vehicle while intoxicated by alcohol, drugs, or a combination of the two. You can be charged with a DWI even if you are not driving at the time of your arrest.

If you are under the age of 21, you can be arrested for a DWI if you have:

  • 0.02 percent or more by weight of alcohol in your blood;
  • 0.1 grams or more by weight of alcohol per 100 milliliters of your blood; or
  • 0.10 grams or more by weight of alcohol per 210 liters of your breath.

A DWI is a Class A misdemeanor in Missouri. This means that you could face up to a year in prison and fines of up to $1,000. You could also be required to pay restitution to any parties that were harmed as a result of your actions.

Missouri's Implied Consent Law

When you are arrested for a DWI in Missouri, you are required to submit to a chemical test. This includes a breath, blood, or urine test. If you refuse to take one of these tests, your driver's license will be suspended for one year. If you are under the age of 21, your license will be suspended for 90 days.

If you refuse to take a chemical test, the officer will take your license on the scene. You will be able to apply for a temporary permit at the police station. This permit will allow you to drive to and from work, school, and doctor's appointments.
